Could rape ever be clever?

Like Ok say for instance someone makes some fake DMV documents and sends them to your house then you drive to said fake DMV and it's all like the movie "The Game" except instead of a birthday present it's a big set up for a huge gang rape, or maybe you're reading a book and then the last line is "you are about to be raped" out of nowhere then someone bursts in your room and rapes you...could a rape have a plot leading up to it that actually makes it a little clever, or is the point that it is rape and is a violent, horrid crime thus negating any thought leading up to it.

I'm wondering if there could be such a clever setup that a judge would smile and say "Ok , that' just a great set up, you're innocent based on how well thought out that was".

i don't see that happening except maybe in Norway.
